Rep. Mihaela Plesa announces bills for court-granted and automatic expunctions

Rep. Mihaela Plesa has introduced two legislative bills, HB 2006 and HB 2042, aimed at reforming the expunction process for individuals found innocent in Texas. The announcement was made through a press release on January 23, 2025.

According to the press release, HB 2006 proposes that statutory county courts be authorized to issue expunction orders for individuals acquitted of crimes in their jurisdiction. Currently, those eligible for expunction must file separate petitions in different courts, which adds time and expense while increasing the caseload of district courts. This bill seeks to streamline the process by allowing the original court to grant expunctions directly.

HB 2042 aims to mandate automatic record expunctions for individuals acquitted of charges within 30 days. Under existing procedures, acquitted individuals must file petitions and bear legal costs to clear their records. By requiring automatic expunctions, this bill intends to eliminate procedural and financial barriers for those proven innocent.

Plesa said in the press release: "Today, we continue the fight to ensure innocent Texans no longer suffer from undue burdens and that anyone proven innocent by the law can continue their lives without fear of reprisal or denigration for which they have been found innocent." She added that these bills would improve judicial and governmental efficiency while unburdening courts and clerks so they can better prioritize their time.

Rep. Mihaela Plesa represents Texas House District 70, which includes parts of Dallas, Plano, Richardson, and Allen. Before her election, she served as a legislative director across multiple sessions focusing on policies such as maternal health and Medicaid expansion. Her priorities in the current legislative session include public school funding and economic development. According to the Texas House of Representatives, she is also noted as the first Democratic woman representing Collin County in the Texas Legislature.
