'President Biden cannot continue governing through executive edicts': Ken Paxton sues CDC to lift mask mandates for air travel

On Feb. 16, Texas Attorney General Ken Paxton filed a lawsuit against the Centers for Disease Control and Prevention (CDC) to end federal mask requirements on airplanes.

According to Texas Tribune, U.S. Rep. Beth Van Duyne (R-Irving) is a co-plaintiff in the litigation. Van Duyne's congressional district includes Dallas-Fort Worth International Airport, the country's second-busiest and the world's fourth-busiest airport by passenger traffic.

The lawsuit asserts the mandate is a “restriction on travelers’ liberty interests.” The federal government previously implemented the mandate requiring passengers using public transportation services or facilities to wear masks in Jan. 2021.

"Biden’s repeated disregard of the individual liberties of Texans is not only disrespectful to the U.S. Constitution, it is also troublesome that any president thinks they can act above the law while hardworking Americans stand by," Paxton said in a statement, according to Texas Tribune. "President Biden cannot continue governing through executive edicts. Now is the time to strike down his administration’s air-travel mask mandate."

Van Duyne previously incurred a $500 fine for violating the U.S. Capitol’s mask policy for a second time.

The current mandate is scheduled to expire on Mar. 18.
