Texas State Rep. David Spiller said property restrictions are not limited to agricultural land or dual citizens but can include minerals, leases, and other interests, with complexities in determining entity ownership through public records. Spiller was a guest on a recent episode of the Texas Talks podcast.
“They don't target individuals with dual citizenship or any individual specifically; there's nothing targeted there," said Spiller on a recent edition of the Texas Talks Podcast. “It's not limited to agricultural property; it's anything. The reasons for that are broad—it could include minerals as well. It's not limited to property purchases; it could be a lease or leasehold interest.”
“All these concepts, as far as distinctions between ownership, property nature, and taxes, are relevant,” said Spiller. “I handle a great deal of contested real estate litigation and own a title company. I deal with these issues through the secretary of state's office, and it's difficult to determine who controls an entity. If you go to the secretary of state's website, you'll see a listing of officers or LLC managers, but you won't know who the members are.”
Spiller, a conservative Republican representing Texas House District 68, has practiced law for over 35 years at Spiller & Spiller, now alongside his two sons. He has served as city attorney for Jacksboro and general counsel for the Jack County Hospital District for over 30 years and is a credentialed advanced mediator.
