Houston-area Texas State Representative Briscoe Cain (R-Deer Park) has introduced legislation aimed at defending Texans' Second Amendment rights ahead of the 2025, or 89th, legislative session.
According to a November 12 tweet from Cain that includes a press release issued by the lawmaker, the bill is known as House Bill (HB) 162, or the "Anti-Red Flag Act," and seeks to "prohibit the recognition, service, and enforcement of extreme risk protective orders."
The release states that the "Anti-Red Flag Act" prevents state and local entities from enforcing or recognizing red flag orders unless explicitly recognized by Texas law. Additionally, it bars Texas entities from accepting federal funds to enforce red flag laws statewide.
Cain outlines four key provisions of the legislation: prohibition of local regulation, making federal law unenforceable in this context, imposing federal funding restrictions, and establishing a criminal penalty. He says in the release that his bill "is about standing up for the constitutional rights of Texans."
